These Terms and Conditions (“Terms”) govern your access to and use of the services provided through the Sukwariya website, mobile application, and related platforms (collectively, the “Platform”). These Terms also include our Privacy Policy and any additional guidelines, policies, or supplemental terms issued by us from time to time (“Supplemental Terms”). In case of a conflict between these Terms and any Supplemental Terms, the Supplemental Terms shall prevail for the relevant services.
The Terms constitute a legally binding agreement between Sukwariya (“Company”, “we”, “us”, “our”) and you (“Customer”, “User”). By accessing or using our Platform or Services, you agree that you have read, understood, and accepted these Terms. If you do not agree, please do not use the Platform or the Services.
1. SERVICES
(a) Sukwariya provides an online Platform that allows Customers to book or access various services offered by independent third-party service providers (“Service Professionals”).
(b) Services directly provided by Service Professionals are referred to as “Pro Services.” Sukwariya does not provide Pro Services and is not responsible for the actions, omissions, conduct, or performance of Service Professionals.
(c) The Platform and Services are for personal and non-commercial use unless otherwise agreed.
(d) Specific brands, categories, or services offered through the Platform may vary and are subject to change.
(e) Sukwariya may send SMS, emails, WhatsApp messages, or notifications related to bookings, updates, or promotions. You may opt out, but this may impact service availability.
(f) You may be required to provide identification for certain services. Failure to do so may result in service denial.
(g) Promotional Credits (“Sukwariya Credits”) may be offered at our discretion and will be subject to applicable terms, validity, and restrictions.
2. ACCOUNT CREATION
(a) You must create an account to use the Services. You must be at least 18 years old.
(b) You agree to provide accurate information and keep it updated.
(c) You are responsible for maintaining account confidentiality and security.
(d) You are liable for all actions under your account.
(e) By creating an account, you consent to receive service-related communications.
3. USER CONTENT
(a) Users may submit reviews, comments, feedback, or other content (“User Content”).
(b) You must not submit misleading, abusive, defamatory, or unlawful content.
(c) You grant Sukwariya a perpetual, royalty-free license to use, modify, publish, or display User Content for business purposes.
(d) Sukwariya reserves the right to remove or moderate any content that violates these Terms.
4. CONSENT TO USE DATA
(a) We collect, store, and process personal data according to our Privacy Policy.
(b) You consent to sharing your information with affiliates or third-party service providers.
(c) Data may be disclosed if required by law or government agencies.
5. BOOKINGS
(a) You may request Pro Services through the Platform. Confirmation depends on service availability.
(b) You will receive booking confirmation by SMS/email/app notification.
(c) Cancellation fees may apply.
(d) If a Service Professional is unavailable, a substitute may be arranged.
6. PRICING, FEES & PAYMENTS
(a) Service charges (“Charges”) are payable directly to Service Professionals.
(b) Sukwariya may charge an additional convenience fee (“Fees”).
(c) Payment methods include UPI, cards, net banking, wallets, or cash (if allowed).
(d) All prices include applicable taxes.
(e) Charges/Fees may be modified without prior notice.
(f) Payments are final and non-refundable unless required by law.
7. CUSTOMER CONDUCT
(a) You must treat Service Professionals with respect and provide a safe environment.
(b) Discrimination or abusive conduct is strictly prohibited.
(c) You must disclose relevant safety, health, or environmental concerns.
(d) Misconduct by Service Professionals must be reported within 48 hours.
8. THIRD PARTY SERVICES
(a) The Platform may contain third-party links or services. Use of such services is at your own risk.
(b) Sukwariya is not responsible for third-party accuracy, terms, or content.
9. USER RESPONSIBILITIES
You agree that:
(a) All information you provide is accurate and not misleading.
(b) You will not engage in fraudulent, unlawful, or harmful activities.
(c) You will not attempt to reverse-engineer, copy, or misuse the Platform.
(d) You will not solicit Service Professionals outside the Platform.
10. INTELLECTUAL PROPERTY
(a) All content, trademarks, technology, and materials on the Platform belong to Sukwariya or its licensors.
(b) Users are granted a limited, non-transferable, revocable license to use the Platform.
(c) Feedback provided by users may be used freely by Sukwariya.
11. TERMINATION
(a) These Terms apply until terminated by either party.
(b) We may suspend or terminate your access for violations or legal reasons.
(c) You may close your account by writing to us.
(d) Certain obligations survive termination, including payment and liability clauses.
12. DISCLAIMERS & LIMITATIONS OF LIABILITY
(a) Services are provided on an “as-is” basis without warranties.
(b) Sukwariya is not responsible for the actions or performance of Service Professionals.
(c) We are not liable for service delays, interruptions, or data loss.
(d) Maximum liability of the Company is limited to INR 10,000.
(e) We are not liable for indirect, incidental, or consequential damages.
13. INDEMNITY
You agree to indemnify and hold Sukwariya harmless from any claims, losses, damages, liabilities, or expenses arising from:
– misuse of the Platform
– violation of these Terms
– services availed from Service Professionals
– breach of any applicable laws
14. GOVERNING LAW
These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of India.
